1. Acceptance of Terms

Welcome to Tolden Search ("Tolden," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our search engine, website, APIs, and related services (collectively, the "Service"). By accessing or using the Service, you agree to be legally bound by these Terms. If you do not agree to these Terms, you must not use the Service.

These Terms constitute a binding legal agreement between you and Tolden Search. Your continued use of the Service after any modifications to these Terms constitutes your acceptance of the updated Terms.

2. Description of Service

Tolden Search is an independent search engine that crawls, indexes, and ranks publicly available web content. The Service provides:

• A search interface for querying indexed web content
• Automated web crawling and indexing of public websites
• Spam detection and content quality filtering
• A public API for programmatic access to search results
• An administrative interface for managing the search index

We reserve the right to modify, suspend, or discontinue the Service at any time with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

3. Eligibility and Account Registration

You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement. If you are under 18, you must have your parent or legal guardian's permission to use the Service.

Tolden Search does not currently require account registration for basic search functionality. Access to administrative features may require authorization. You are responsible for maintaining the confidentiality of any credentials and for all activities that occur under your access.

4. Acceptable Use Policy

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service in any way that violates applicable local, national, or international laws or regulations
• Transmit any unsolicited or unauthorized advertising or promotional material
• Engage in any conduct that restricts or inhibits anyone's use of the Service
• Attempt to gain unauthorized access to any portion of the Service or its related systems
• Use automated tools, bots, or scrapers to excessively access the Service beyond normal usage
• Attempt to interfere with or disrupt the Service, servers, or networks connected to the Service
• Use the Service to collect or harvest personal information about others
• Bypass or circumvent any rate limiting, access controls, or security measures
• Reverse engineer, decompile, or disassemble any component of the Service
• Impersonate any person or entity or misrepresent your affiliation with any person or entity

We reserve the right to terminate or suspend access to the Service immediately, without prior notice or liability, for any violation of these Terms.

5. API Usage and Rate Limits

5.1 API Access

The Tolden Search API is provided for legitimate programmatic access to search results. API access is subject to rate limiting to ensure fair use and service stability.

5.2 Rate Limits

The default rate limits are:

• Search API: 60 requests per minute per IP address
• Crawl API: 5 crawl initiation requests per hour per IP address

Exceeding these limits may result in temporary or permanent suspension of access. Commercial or high-volume use requires prior written agreement.

5.3 API Attribution

Applications using the Tolden Search API must clearly attribute results to "Tolden Search" and must not present results as originating from any other search engine or service.

6. Intellectual Property

6.1 Our Content

The Service, including its software, design, logos, trademarks, and all content created by Tolden, is owned by Tolden Search and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

6.2 Third-Party Content

Search results contain links to and excerpts from third-party websites. We do not claim ownership of third-party content and are not responsible for its accuracy, completeness, or legality. The inclusion of a link or excerpt in search results does not constitute an endorsement.

6.3 Copyright Infringement

We respect intellectual property rights. If you believe that content indexed by Tolden infringes your copyright, please contact us with a notice that includes: identification of the copyrighted work, identification of the allegedly infringing material and its location, and your contact information.

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices regarding the collection, use, and disclosure of information.

8. Disclaimers and Limitation of Liability

8.1 Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or usefulness of any information provided through the Service.

8.2 Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL TOLDEN SEARCH BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

Our total liability for any claim arising out of or relating to these Terms or the Service shall not exceed the greater of $100 or the amount paid by you, if any, to use the Service in the past twelve months.

9. Indemnification

You agree to defend, indemnify, and hold harmless Tolden Search and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to: (a) your violation of these Terms; (b) your use of the Service; or (c) your violation of any third-party rights, including any intellectual property rights.

10. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Tolden Search operates, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall first be attempted to be resolved through informal negotiation. If informal negotiation fails, disputes shall be submitted to binding arbitration.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by updating the "Last Updated" date at the top of these Terms. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.

12. Severability and Entire Agreement

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Tolden Search regarding the Service and supersede all prior agreements.
